This Fair Use Policy (“Fair Use”) discloses how David Buchanan, dba MastersOfVideoMarketing.net (“Company,” “I,” “we,” “my,” “me,” “us,” and “our”) uses content provided by other content creators on this website, www.mastersofvideomarketing.net (the “Site”) in accordance with U.S. Copyright Act of 1976 U.S.C. #167.

Let it be known that some of the articles, images, graphics, videos, audio files, documents and other content related to this Site (collectively “Content”) are not the intellectual property of David Buchanan or the Company and were not created by David Buchanan. I have used these materials for the purpose of illustration, training and entertainment for our visitors. The creator/owner is indicated in the video, image, audio file or description of the post and permission for use on this Site has been granted by the video sharing website used by the audio and video creator. I use this Content under the U.S. Copyright Act of 1976 U.S.C. #167; 107 which allows for the use of work that is used for comment, criticism, or education and is non-profit in nature.

Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
a. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
b. the nature of the copyrighted work;
c. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

How I Use Videos from YouTube and Other Video Sharing Websites

Video sharing websites (e.g. YouTube, Vimeo, Instagram, Pinterest, Rumble, etc.) have video sharing policies that allow anyone to embed a public video hosted on their website on a personal website. An embedded video provides additional traffic and advertising revenue for both, the video creator and the video sharing website. Therefore, when you upload your video to a video sharing website you are giving permission for your video(s) to be shared on any device and/or third-party website in the public domain of the internet. I use the permission granted by YouTube and other video sharing websites to embed what I believe are the most important videos of interest to my Paid Membership on my private website.

To be clear, the videos embedded on my website are from video sharing websites like, YouTube, TikTok, Instagram, Pinterest, Rumble and many others. They are the creative effort of third party USERS and video creators unless specified in the description. The image and video sharing websites I use provide special embed links to the USER/CREATOR’s images and videos, and give permission to the public to embed and share the images and/or videos hosted on their website on any public or private website, social media account, image sharing platform and by email.

My goal is to provide valuable content for my members and give you, the video creator, additional advertising and publicity. I make every effort to acknowledge and give thanks to the USER/CREATOR on the image/video sharing account for allowing us to include their creative materials on our website. I strive to attribute the ownership and/or copyright to the proper USER/CREATOR on the image/video sharing website and allow public and private visitors to my website to click a link on the image/video or the text of our post and go to the source image/video sharing website. I will not be held responsible for vetting and/or authenticating the copyright status, permission status and/or the original USER/CREATOR’s right to publish the image or video on the source sharing website. The sole responsibility of the copyright vetting process is the original hosting company of the image/video sharing website or social media platform.

My main purpose is to share inspiring information that I admire and appreciate in celebration of creative effort and give special recognition to the USER/CREATOR who has allowed me to share their insight and experience with my readers, subscribers and members. I encourage my audience to visit the USER/CREATOR’s video channel, social media platform and/or personal website, and I do so without compensation. I believe that in sharing knowledge and wisdom with each other, in a public forum, all of us together can make our world a better place to live.

I do not pretend or suggest that any creative work that is not specifically created by David Buchanan, or an employee of the Company, is in fact the creative property of David Buchanan. I make every effort to inform my readers of the creator(s) and owner(s) of all copyrighted materials. If you are the USER or CREATOR of any shared video on my website and do not want your video to be shared on any other website, then you can change the settings to private or unlisted in the control panel of your video hosting website. By making your video unlisted or private, your video will be immediately disabled on all websites that share a link to your video, including mine.
